Can a teacher or principal forcefully make you empty your pockets at school?
June 3rd, 2010 | by admin |At my high school we are not allowed to have cell phones on us during the school day. The phones must be in our locker and turned off. During study hall someones phone went off. The teacher then asked who’s phone it was, and no one admitted to their phone going off. So the teacher said that she was going to make everyone empty their pockets. I had my phone in my pocket, and was wondering what would happen if I refused to empty my pockets.
Yes they can. It is school policy, you are on their grounds, you are under their rules.

They can’t actually grab your pockets and drag whatever they want out; but they can call the cops if they suspect illegal material.
Most of it is scare tactics; I had some jerks for admins when I was in school.

yes the laws change when you inter school grounds for instance you no longer have freedom of speech

As a general rule, school administrators have "parental authority" over their students. This is why locker searches, and (in you case) non-invasive personal searches (pockets, book bags, purses, etc.) are allowed.

If you refused, then they could eventually follow the necessary steps required in your area to search you. If they have a rule such as this, then you are required to follow it. Why waste the time and potential trouble by simply being stubborn?

detention, suspension but probably not been kick out of school or anything. And yes a teacher can make you empty your pockets, if your not supposed to have your phone on you, and they believe you do, they can confiscate it.
